This website 'www.apeturedesigns.com.au' is owned and services by Aperture Designs - ABN 28 933 414 186. At the acceptances in we, (Aperture Designs) provide you, (Client) our services therefore client agrees and accepts to the terms and conditions founded at www.apeturedesigns.com.au.
Copyright / Ownership
1. The client will have the reproduction rights after the projects has been paid in full and cleared.
2. Prices do not include printing. Printing and delivery prices are available on request.
3. Aperture Designs reserve the right to use the artwork, at any stage of the design, for any marketing purpose, publications, website promotions, social media, etc, all without consent to the client (s).
4. The client is responsible for submitting accurate written content/data/artwork. Aperture Designs will take no responsibility for mistakes in the supplied content/data/artwork.
Completion of works
Aperture Designs and client(s) must work together to complete the artwork project in a timely manner accordingly to the writing brief supplied to the client. Once the writing brief is approved and agreed by both Aperture Designs and client, the client therefore must submitted all necessary materials, if required before any project work commences. A deadline then is acknowledged.
The client agrees to pay a 30 per cent (30%) deposit of the quoted amount before commence of any projects begins. Once final artwork, websites design or photographs are completed and approved by the client, Full payment is required before supplied to the client and cleared and paid within 7 calendar days of date of invoice issued. If client has change of mind and no longer engaging within the project at client's discretion, the client must pay for the artwork, website or photographs which have been produce, complete or not. A refund payments will not be issued.
In the event of cancellation of a project Aperture Designs will retain ownership of all copyrights and original artwork. If the client(s) may terminate the projected without given cause upon, deposit payment will be not be refunded.
Incompletion of Artwork
If the client, within 14 working days, once the artwork as been emailed to the client's supplied email address, does not attempt to respond or make contact with Aperture Designs for the amendments or proofing of artwork, website design or photographs, then Aperture Designs reserves the right to assume that the artwork carried out is no longer in the interest of the client (s). Thereafter a final payment invoice will be issued to the client.
Once a website is published Online, the client is wholly and solely responsible for the content that appears on the website spelling and grammar. Aperture Designs can not ensure keeping up with technology insuring websites display correctly in all major browsers or mobile devices.
Aperture Designs will not be responsible in care keeping client files on our computer or back up systems , that of finished signed off artwork or photographs.
if the Client request original source files once after all proofing is agreed and payment is made and cleared a file recovery fee is charged to the client, based on the amount of files requested.
Aperture Designs makes no warranties of any kind of client(s) misplayed, lost or damaged files, during or after all proofing is agreed and payment is made and cleared.
Unless otherwise stated, Copyright Act 1968, all images are owned by Aperture Designs - ABN 28 933 414 186. The Client must under no circumstance use an unpaid photographs for Internet display (Online social media) or print purposes, including thumbnail viewing.
Printing of Art Work
By accepting that Aperture Designs is commissioned to complete client artwork design, automatically accepts that condition that Aperture Designs is not responsible for any client supplied third party artwork/images that do not print to the clients fulfillments. All artwork files supplied to the printers shops is of only high press quality at 300dpi resolution PDF or at the printers shop required specifications.
On-screen RGB proofing is not accepted as final printing, at which the client may believe to be the case, therefore assuming that which appears on RGB screen is that will appear equal in colour at the final print. Aperture Designs makes no warranties for any colour variations that may occur between on-screen proofs and the final printed outcome. As printing shops vary from one to another and such be be used as a guide from previous final printing colour or proofs.
Aperture Designs will not be liable for costs of final approved design work, that of, approved by the client that is supplied to the printer via Aperture Designs or by the client(s), that of , which may contain errors, grammar, spelling mistakes or colour variation incurred, nor pay out compensation for loss of earnings due to the failure to meet agreed deadlines.
Client acknowledges that it shall be responsible for performing the following in a reasonable and timely manner:
(a) coordination of any decision-making with parties other than the Designer.
(b) provision of client content in a form suitable for reproduction or incorporation into the deliverables without further preparation, unless otherwise expressly provided in the Proposal;
(c) final proofreading and in the event that client has approved Deliverables but errors, such as, by way of example, not limitation, typographic errors or misspellings, remain in the finished product, client shall
incur the cost of correcting such errors.
Aperture Design associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretions. Such cancellation notification will be put in email with in seven working days at an active supplied to the client.
All proofs are in low resolution draft mode and not for finished print. The client must confirm draft proofing by email thereafter approve or require revisions to supplied proofs, within 14 days of receipt of proofs. Any artwork, photographed or website design/graphic thats is produced and not followed up for revision or proofing within 30 calendar days from the starting date quoted will be deleted. The client must notify Aperture Designs, that there's to be a HOLD status on the current artwork or website files in current production. If no notification is addressed by the client, all work in progress files will be deleted and no payment refund to the client will be admitted, unless written notice is given prior 30 calender days from the starting date quoted, at that point well will put artwork an d proofing files on hold.
In the duty of care at which the client hires Aperture Designs to product artwork or photography , we (Aperture Designs) makes every effort to ensure that the information contained within the artwork design complete. We give no warranty that the documents, goods or services will be free of errors, or artwork defects and no responsibility for any errors or omissions of any kind in the artwork design or photographs supplied.
Each party, it's agents and employees shall hold and maintain in strict confidence all Confidential Information, shall not disclose Confidential Information to any third party, and shall not use any Confidential Information.
